Goods in Transit: Insurance Terms & Conditions

MyKargoLink has partnered with AFC to protect you legally by directly insuring your goods on our platform. This collaboration ensures streamlined claims processing and verified coverage for every load moved through our network.

1. Insurance Obligation

The Transporter shall, at its own sole cost and expense, procure and maintain a comprehensive Goods in Transit (GIT) insurance policy. This policy must cover all cargo tendered by the Shipper against "All Risks" of physical loss or damage from any external cause while in the custody, control, or care of the Transporter.

2. Claims Procedure & Order of Action

In the event of loss, theft, or damage, the following sequence must be strictly followed:

  • Step 1: Immediate Notification — The Transporter must notify the Shipper and the Insurer within 24 hours of the incident.
  • Step 2: Recording Damage — For visible damage, the Shipper or consignee must note specific damage on the Proof of Delivery (POD) at the time of offloading.
  • Step 3: Evidence Submission — The Transporter must provide all necessary assistance, including driver statements, police reports, and vehicle telematics, to support the claim within 48 hours.
  • Step 4: Assignment of Rights — The Transporter irrevocably assigns the right to file, negotiate, and settle claims directly to the Shipper.

3. Shipper as Loss Payee

It is an express condition of this agreement that:

  • The Shipper's interest in the goods shall be noted on the Transporter's insurance policy.
  • The Shipper is designated as the Loss Payee. Any insurance proceeds shall be paid directly to the Shipper by the insurer.

4. Proof of Coverage

Before transit begins, the Transporter must provide a Certificate of Insurance clearly stating:

  • The policy number and insurer's contact details.
  • The limit of liability per load (which must meet or exceed the full commercial value of the goods).
  • Confirmation that the policy is currently in force and premiums are paid.

5. Exclusions and Limitations

The Transporter shall be held liable for the full value of the goods, regardless of insurance coverage, if a claim is rejected due to:

  • Failure to pay insurance premiums.
  • Theft from an unattended vehicle where security protocols were not followed.
  • The use of unroadworthy vehicles or unlicensed drivers.
  • Insufficient or improper securing of the load by the Transporter's staff.

6. Valuation of Goods

For the purpose of any claim, the value of the goods shall be the Commercial Invoice Value plus any prepaid freight charges, unless a different "Declared Value" was agreed upon in writing prior to transit.

Important Note for the Shipper

While this contract protects you legally, insurance companies move slowly. To protect your cash flow, always ensure the Limit of Liability on the Transporter's certificate is high enough to cover your most expensive load before authorizing transit.
